As absentee and affidavit ballot counts continue, Republican challenger Claudia Tenney continues to lead in the race for New York’s 22nd Congressional District — though her lead over incumbent U.S. Rep. Anthony Brindisi, D-Utica, has tightened.

Three counties in the congressional district are reporting preliminary results as of Monday, which have edged Brindisi closer. After Election Day, in-person voting results showed the first-term congressman behind by more than 28,000 votes.

More than 50,000 absentee ballots will be counted in the race, with the state Board of Elections reporting that more than 69,000 absentee ballots were mailed to voters throughout the eight-county district.

Preliminary results show Brindisi ahead of Tenney in Cortland County, with 11,079 votes to the former congresswoman’s 9,551. Brindisi took the lead after receiving 3,619 absentee and affidavit ballots to Tenney’s 1,117 in the county.

Brindisi also gained some ground in Tioga County, with 741 absentee and affidavit votes to Tenney’s 306. The Democrat still trails in the county when adding in Election Day totals, with Tenney ahead 3,051 to 2,676.

The Herkimer County Board of Elections released preliminary numbers Monday afternoon, showing Tenney leading in the county with 13,569 votes to Brindisi’s 10,004. Tenney’s lead in the county from Election Day has shrunk, when she was ahead by nearly 5,000 votes — 12,467 to 7,637.

In Madison County, Brindisi picked up 4,330 absentee votes to Tenney’s 1,663. Tenney leads in the county, 17,023 to 15,556, based on preliminary results posted to the county’s website.

Brindisi also picked up nearly 1,000 votes from absentee ballots in Oswego County, with 2,024 to Tenney’s 1,053. When combined with Election Day results, Tenney remains ahead, 13,401 to 7,329, in Oswego County, with about 580 affidavits left to count, according to the county’s board of elections.

Chenango County Board of Elections Republican Commissioner Mary Lou Monahan said the county should be finished counting ballots by Thursday.

Oneida County and Broome County boards of elections did not respond to requests for comment and results.

Oneida County reported more than 15,000 absentee ballots received, while Broome County had more than 17,000 absentee ballots, according to state Board of Election figures.

Preliminary figures from the state show more absentee ballots have been received from Democrats — 23,631 of 31,774 — than Republicans — 15,158 of 20,928. The third-largest block of voters is unaffiliated with 8,376 ballots of 12,001 already received.

A report on the election totals included in the race for New York’s 22nd Congressional District shows the race has narrowed to just 13 votes.

It also marks the first time any unofficial vote total has shown U.S. Rep. Anthony Brindisi ahead, after trailing former congresswoman and Republican challenger Claudia Tenney by more than 28,000 votes on Election Day.

The Cook Political Report results show Brindisi ahead 155,435 votes to Tenney’s 155,422, with Libertarian Keith Price at 6,450 votes.

The rematch of a close 2018 election was considered a toss-up by various political outlets, including the Cook Political Report, prior to November.

Contested ballots are undergoing judicial review by state Supreme Court Justice Scott DelConte, who issued an injunction in the case on Tuesday. A true picture of the results in the race won’t be available until DelConte makes a ruling on hundreds of contested ballots in the case, which resumes when motions are filed by the campaign legal teams Monday.

Both campaigns have pulled some objections to ballots during court proceedings on Monday for issues such as identifying marks on the ballot. Those ballots would still be included in the current counts from the county used in the Cook Political Report figures.

Brindisi, a Utica Democrat, called the judicial review “fair, open, honest and transparent” in a tweet Wednesday. A follow-up Tweet from the first-term congressman expressed confidence he would prevail.

Tenney campaign spokesman Sean Kennedy decried “unfair, unwise and unilateral rules changes” brought by Gov. Andrew Cuomo’s executive orders on the election that have caused “utter dysfunction,” in a statement Wednesday. Kennedy also referred to issues in documenting challenges to ballots and if voting procedures were properly followed.

“The hearing in court has already established that the current tally includes invalid votes and that the process to review and count the massive amount of paper ballots is fractured,” Kennedy said. “Today’s misleading and inaccurate tally is rife with errors and mistakes that must be rectified before this election is certified. It is far from final.”

DelConte’s injunction prevents the board of elections in the congressional district’s eight counties — Broome, Chenango, Cortland, Herkimer, Madison, Oneida, Oswego and Tioga — from certifying results in the contest between Tenney and Brindisi.

Independent confirmation of updated unofficial vote totals in six of the eight counties in the congressional district shows the race remains close.

Broome County has Brindisi ahead with 50,713 votes to Tenney’s 36,595 in the latest unofficial results. He also leads in Cortland County, with 11,079 votes to Tenney’s 9,551.

In Madison County, Tenney is ahead by 17,045 votes to Brindisi’s 15,673, based on unofficial results. She also leads in Herkimer (13,652 to 10,121), Oswego (13,567 to 7,413) and Tioga (3,056 to 2,689) counties compared to the first-term incumbent.

Chenango and Oneida counties have not provided updated unofficial vote totals in the race since the beginning of the judicial review. This story will be updated when the updated unofficial vote counts become available.
